Protecting your privacy is important to Lenox Corporation ("Lenox"). Lenox markets and sells products under the LENOX, ONEIDA, CAMBRIDGE, HAMPTON FORGE and REED & BARTON brand names. This Privacy Policy (the "Policy") describes how we collect, share and secure information provided by you on our website Lenox.com and any other website that is own, licensed, or operated by Lenox or a Lenox Brand (collective, a "Website"). 

By visiting our Website, submitting information and/or purchasing any products, you agree to let us collect and use your Personal Information as described in this Privacy Policy. This Privacy Policy also sets forth your rights, liabilities, and responsibilities with such Personal Information Therefore, before you provide us with any Personal Information, you should read through this Privacy Policy in its entirety and understand its terms. We may update this Privacy Policy from time to time, so please check it occasionally. This Website is not intended to sell or ship products to customers outside of the United States. If you wish to do so, please visit one of our authorized resellers. 

This Privacy Policy applies to Personal Information that Lenox receives during its business operations as a “data controller” - which means we determine the purpose and means of processing such Personal Information. For purposes of this Privacy Policy, the term “Personal Information” means any information that, alone or in conjunction with other information or data, identifies or is linked to a particular individual, household, or device and that is subject to, or otherwise afforded protection under, a data protection law, statute, or regulation. The term “Personal Information” does not include anonymized or de-identified data that is not attributable to a particular individual, household, or device and that is not otherwise subject to a data protection law, statute, or regulation. Lenox may anonymize or de-identify Personal Information, and such data is not subject to this Privacy Policy, and Lenox may use such data for any purpose.

A.  Information You Voluntarily Provide
When you interact with us, we collect information that you voluntarily share with us. For example, you may give us your personally identifiable information, which includes, but is not limited to, identifiers such as your name, username and password, address (postal and email), telephone number (“Personal Information”) by filling in forms or by corresponding with us by post (e.g.., product reviews, ratings, feedback), phone, email or otherwise. When you communicate with us, we will collect whatever information you volunteer. You should therefore not send messages or share content that you do not want us to see, save or share.


B.  Information We Get When You Use Our Website or Services 
When you use our Website, we collect information about you and your use of the Website. For example, we collect the following types of information when you use our Website or services:

  • Personal Information

We may collect certain Personal Information when you use our Website, place an order or provide information to us, such as when you create an account, fill out registration forms, visit our retail stores, register for our Lenox Replacement Promise, enter a contest or marketing event, sign up for a catalog, or otherwise contact us. The information we may collect includes the following information: name, address, email phone number, and credit card information. While we provide our consumers the convenience of purchasing products through a credit card, we do not take possession of our consumers’ credit card information. Rather, that information is provided directly to a third party service provider for processing. Accordingly, the Personal Information retained by Lenox does not include consumers’ credit card information or number. 

If you register for our Lenox Replacement Promise you also have the option of providing your birthday and wedding date as well as registered products. If you use our "Email to a Friend" feature, the name and email address information requested will be used only to generate that email. It will not be used for any other purpose. 

We collect and retain records of the products you purchased, obtained, or considered, or your other purchasing or consuming histories or tendencies with respect to our products, Website, and services. We also collect information with respect to your marketing preferences and your subscriptions to our publications and alerts. 

  • Usage Information and System Information; Cookies

When you access and use the Website, we automatically collect details of your access to and use of the Website, including traffic data, usage logs and other communication data, and the resources that you access and use on or through the Website (e.g., browsing history, search history). We may also collect information about your device and internet connection, including the device’s unique identifier (e.g., device type, IMEI, Wi-Fi MAC, IP address), operating system, browser type, and mobile network information. If you contact us on a social media platform for customer support or for other reasons, we may contact you via the social media’s direct message tools. Your use of a social media platform is subject to the policies and terms of the relevant social media platform. Certain social media platforms may also automatically provide us with your personal information, the information we receive will depend on the terms that govern your use of the social media platform(s) and any privacy settings you may have set. Our Website may include social media features and widgets (e.g., the “Facebook Like” button, the “Share This” button) or interactive mini-programs. These features may collect your IP address and which Website page you are accessing and may set a cookie to enable the feature to function properly. Our Website is not directed to children under 16 years of age and we do not provide intend to provide our goods or services to children, or knowingly collect or solicit personal information from children under 16 years of age.

If you make any request related to your personal information, Lenox will ascertain your identity (and the identity of the authorized agent, to the extent applicable) to the degree of certainty required or permitted under the law before addressing your request. In particular, before granting you access to, erasing, or correcting, specific pieces or categories of personal information or otherwise responding to your request, Lenox will, to the extent required or permitted by law, (i) require you (or your authorized agent) to verify your request via email, (ii) request certain contact information or government identifiers, and (iii) match at least two pieces of such personal information with data that we have previously collected from you. None of your privacy rights are absolute, and such rights are subject to exceptions and exemptions.

If you would like to appeal a decision Lenox has made with respect to your privacy request, please email us in accordance with the “Contact Us” section listed below, with the subject line “ATTN: Privacy Appeals,” and describe the nature of your request, and the reason for requesting an appellate review.  

Opt-Out Rights / The Sale of Personal Information. You may have the right to opt out of the “sale” of their personal information. However, Lenox does not sell your personal information to third parties for monetary consideration or other valuable consideration, and therefore we do not provide opt-out request processes for the sale of personal information (because we do not undertake such activities). Nevada residents may submit a request directing us to not sell personal information we maintain about them to third parties who will sell or license their personal information to others. If you would like to exercise this right (even though we do not sell or license personal information), please contact us in accordance with the “Contact Us” section listed below. 

Opt-Out Rights / Targeted Advertising. You may have the right to opt out of having your personal information used for targeted advertising purposes. Lenox uses third-party analytical and targeted advertising features on our Site and similar web tools provided by our marketing partners.   • Right to Know (Specific Pieces of Personal Information). You have the right to know the specific pieces of your personal information that we have collected about you. 
  • Right to Know (Categories of Personal Information). You have the right to know (i) the categories of personal information we have collected from you; (ii) the categories of sources from which the personal information is collected; (iii) the categories of your personal information we have sold or disclosed for a business purpose; (iv) the categories of third parties to whom your personal information was sold or disclosed for a business purpose; and (v) the business or commercial purpose for collecting or selling your personal information. 
  • Right to Delete. You have the right to request that we delete your personal information that we have collected and retain. 
  • Right to Correct. You have the right to request that we correct inaccurate personal information that we have collected and retain. 
  • Nondiscrimination. You have the right not to be subject to discrimination for asserting your rights under the CCPA. 

Submit a Privacy Request. To submit a privacy request, you (or your authorized agent) may contact us in accordance with the “Contact Us” section listed below. However, any such authorized agent must be registered with the California Secretary of State to conduct business in California. 

Privacy Request Verification Process. If you (or your authorized agent) make any request related to your personal information, Lenox will ascertain your identity (and the identity of the authorized agent, to the extent applicable) to the degree of certainty required or permitted under the law before addressing your request. In particular, Lenox will, to the extent required or permitted by law, require you (or your authorized agent) to verify your request via email, request certain contact information or government identifiers, and we will match at least two pieces of such personal information with data that we have previously collected from you before granting you access to, erasing, or correcting, specific pieces or categories of personal information, or otherwise responding to your request. We may require written documentation that demonstrates a third party is authorized to serve as your agent for the purposes of submitting the requests set forth herein, unless you have provided the authorized agent with power of attorney pursuant to California Probate Code §§ 4121 to 4130. None of the CCPA’s rights are absolute, and such rights are subject to legal and regulatory exceptions and exemptions. Opt-Out Rights / Do Not Sell My Personal Information. California residents have the right to opt out of the “sale” of their personal information. However, Lenox does not sell your personal information to third parties for profit or monetary or other valuable consideration, and therefore we do not provide opt-out request processes for the sale of personal information (because we do not undertake such activities). 

Opt-Out Rights / Do Not Share My Personal Information. California residents have the right to opt out of the “sharing” of their personal information. Lenox uses third-party analytical and targeted advertising features on our Site and similar web tools provided by our marketing partners, and such features, tools and marketing relationships involve the disclosure of your personal information to third parties and may constitute the “sharing” of your personal information for CCPA purposes. To opt out of this sharing of your personal information in these circumstances, please click on the cookie management tool (sometimes visible as a “Your Privacy Choices” or a “Do Not Sell/Share My Personal Information” link on the footer of the Site) to set your cookie preferences. You, or your authorized agent, may also contact us in accordance with the “Contact Us” section listed below. 

Children. The Site is not directed at, and should not be used by, minors under the age of sixteen (16), and therefore Lenox does not knowingly sell or share the personal information of minors under sixteen (16) years of age. 

Limit Use of Sensitive Personal Information. Lenox does not use or disclose sensitive personal information for reasons other than those set forth in the CCPA, and therefore we do not provide individuals with the ability to limit how we use or disclose such sensitive personal information.  

Financial Incentives 
We may collect and use Personal Information to offer you financial incentives, or price or service differences, such as discounts, benefits, or other unique rewards for the disclosure of your Personal Information. If you consent to participate in these offerings, you may withdraw that consent at any time by contacting us using the contact details set forth herein. Pursuant to the CCPA, you may be entitled to be informed as to why our financial incentives, or price or service differences, are permitted under the law, including (i) a good-faith estimate of the value of your Personal Information that forms the basis for offering the financial incentive or price or service difference, and (ii) a description of the method we used to calculate the value of your Personal Information. Generally, we do not assign monetary or other value to any Personal Information we collect. However, in the event we are required by law to assign such value in the context of our financial incentives, or price or service differences, we have valued the Personal Information collected and used as being equal to the value of the discount or financial incentive provided, and the calculation of the value is based upon a practical and good-faith effort often involving the (i) categories of Personal Information collected (e.g., names, email addresses), (ii) the transferability of such Personal Information, (iii) the discounted price offered, (iv) the volume of consumers enrolled in our marketing programs, and (v) the product or service to which the financial incentive, or price or service difference, applies. The disclosure of the value and calculation described herein is not intended to waive, nor should be interpreted as a waiver to, our proprietary or business confidential information, including trade secrets, and does not constitute any representation with regard to generally accepted accounting principles or financial accounting standards. 

XV.  Other California Privacy Rights

As referenced in this Privacy Policy, we may from time to time elect to share certain Personal Information for those third parties’ direct marketing purposes. California Civil Code Section 1798.83 permits California residents who have supplied Personal Information, as defined in the statute, to us to, under certain circumstances, request and obtain certain information regarding our disclosure, if any, of Personal Information to third parties for their direct marketing purposes.
